By submitting the required information and signing below, I/We, the applicant(s), agree to the terms and conditions outlined in this Rental Application Agreement ("Application") and acknowledge my commitment to comply with the privacy policy and all terms set forth by Property Duke Inc.
1. Financial Obligations and Refund Policy:
In order to submit an Offer to Lease Agreement to the property owner, I am required to make an initial payment of $300.00 through the email tranfer to Payments@propertyduke.com, referencing your first and last name. This prepayment will be credited toward the last month's rent. If the property owner rejects the offer or fails to respond within three business days, the prepayment will be refunded. The refund will be processed via direct deposit. Upon refund, the Application and Offer to Lease Agreement will be deemed terminated, with no further obligations on either party.
If the property owner accepts the Offer to Lease Agreement, I must pay the remaining balance for the last month's rent within one business day. Additionally, I am required to pay the first month's rent and a $250 key deposit within three business days after the Offer to Lease Agreement is accepted. I will also provide proof of utility transfers and obtain a tenant insurance policy with a minimum $2 million legal liability coverage.
2. Bankruptcy Representation:
I represent that no bankruptcy proceedings are currently underway or anticipated against me.
3. Accuracy of Information and Consequences for Breach:
I affirm that all information provided in this Application is complete and accurate to the best of my knowledge. I understand that providing false, incomplete, or misleading information may result in the rejection of my Application and may terminate my right to occupy the premises under any Lease Agreement. If any information is found to be false or inaccurate, or if I fail to meet payment deadlines, I acknowledge that my prepayment for the last month's rent and any additional payments may be forfeited. Furthermore, I accept responsibility for any lost rental income incurred by the property owner and for costs associated with securing a new tenant, including a fee equal to one month's rent, a setup fee of $149, and applicable taxes. A document verification fee of $129 per tenant will also be charged, plus any applicable taxes.
4. Document Verification and Personal Data Use:
I confirm that I have reviewed all relevant documents before submitting this Application. I release Property Duke Inc. from any liability for actions taken in verifying the information I provided. I understand that Property Duke Inc. may require additional documentation, such as government-issued ID, proof of income, bank statements, and references. I agree that failure to submit required documents within three days of the Offer to Lease Agreement being approved will be considered a breach of this Application. Property Duke Inc. is authorized to collect and use my personal information for purposes such as assessing creditworthiness, managing lease agreements, and sharing data with relevant agencies.
5. Consent for Reporting and Liability Release:
I consent to Property Duke Inc. reporting my rental payment history to appropriate agencies and release all parties involved from liability. My personal information will be handled according to Property Duke Inc.'s privacy policy. If applicable, I confirm that any co-signers or household members listed in this Application are aware of and consent to this process.
6. Legal Rights, Liability Limitations, and Confidentiality:
In the event of legal proceedings related to this Application, I acknowledge that this document serves as a full defense and agree not to contest its applicability in subsequent legal actions. I understand and agree that Property Duke Inc. and its affiliates shall not be liable for any damages, losses, or legal issues arising from this Application, Lease Agreements, or occupancy of the rental property. I also agree to keep all details of this Application confidential unless required by law.
7. Acknowledgement of Understanding and Agreement:
I confirm that I have read and understood all the terms and conditions outlined in this document before proceeding with any payments or completing this Application. By proceeding with this Application, I affirm my understanding and agreement to all terms and conditions.
